BCBS Class Action Lawsuit

Many of you have likely heard about the Blue Cross Blue Shield Lawsuit Settlement either by staff or even on the news. I wanted to send some information and resources for you to help guide your staff if any questions come up. Below is the latest “Fact Sheet” we received from the Blue Cross Consortium with some helpful information about the Class Notice and Claims Process.

The Fact Sheet is being provided for informational purposes only and is not an official class notice. If you have questions please visit the settlement website at www.BCBSsettlement.combeing managed by the Court approved claims and notice administrator – JND Legal Administration. On the website, you will find important information about the settlement, including FAQs and the Court-approved Notice (under the “Important Documents” tab).  If you have further questions about the settlement, you may also call 1-888-681-1142 or email info@BCBSsettlement.com.

Beginning (immediately), members of the Damages Class will start receiving notification by email and mail about the class action and their rights associated with the settlement, including that they may be eligible for a payment. In addition, TV, radio, print, online, and social media advertising will publicize the settlement, including using the Blue Cross and Blue Shield trademarks. This is standard practice for settlements like this.

You may have been contacted, or heard of other employers being contacted by third parties. The Fact Sheet provides some additional information on this point:

  • We understand that entities are reaching out to potential class members soliciting business related to the settlement. The Court has appointed JND Legal Administration to administer settlement claims. JND has established an official website - www.BCBSsettlement.com - where Court-approved information about the Settlement is available. The website also contains a copy of the claim form, which is designed to be simple and straightforward to fill out. Any other entity soliciting business related to the settlement is not affiliated with Blue Cross Blue Shield Association, Blue Cross Blue Shield companies, the Court, plaintiffs, or the Claims Administrator. If you have questions related to the class notice or claims administration process, please go to  www.BCBSsettlement.com.

We’ll continue to keep you updated as we learn more. In the meantime, as with any legal matter we recommend you involve your counsel regarding this lawsuit.
